The Environmental Protection Agency plans to publish National Pollutant Discharge Elimination System draft regulations in the Federal Register June 4.
The regulations, which govern pesticide discharge into waterways, are the result of a lawsuit in which the EPA was found guilty of not enforcing the Clean Water Act.
The draft regulations don't cover application of pesticides to cropland. Instead, they address pesticide runoff from cropland and pesticide drift into waterways.
The EPA estimates that the Sixth Circuit's ruling will affect about 365,000 pesticide applicators nationwide that perform 5.6 million pesticide applications annually.
